These Terms govern access to and use of Hellotik, including our ticketing, live chat, and customer support management services.

1. Acceptance of Terms
By creating an account, accessing, or using Hellotik, you agree to these Terms and our Privacy Policy. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.
2. Service Description
Hellotik provides software features for support ticket management, live messaging, user and role administration, collaboration, analytics, and related customer support workflows.
3. Accounts and Access
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining confidentiality of login credentials.
- You are responsible for activities under your account and workspace.
- We may suspend or restrict access where required for security, misuse prevention, or legal compliance.
4. Acceptable Use
You agree not to:
- Use the service for unlawful, harmful, fraudulent, or abusive purposes.
- Upload or transmit malware, exploit platform vulnerabilities, or attempt unauthorized access.
- Interfere with service stability, performance, or security controls.
- Infringe intellectual property, privacy, or other rights of third parties.
5. Customer Data and Content
You retain ownership of data and content you submit to the platform, including tickets, chats, and attachments. You grant us a limited license to host, process, and transmit that data solely to operate, secure, and improve the service.
6. Subscriptions, Billing, and Payments
- Paid features are offered by subscription plans as presented at checkout.
- Billing and payment processing are handled through Polar and related payment partners.
- Fees are due as specified for your plan cycle (monthly or annually).
- Taxes, where applicable, may be added according to law.
- Refunds and cancellations are subject to our Refund Policy and applicable law.
7. Service Changes and Availability
We may modify features, pricing, and technical requirements from time to time. We aim for high availability but do not guarantee uninterrupted, error-free operation at all times.
8. Intellectual Property
The platform, software, branding, documentation, and related materials are owned by Hellotik or its licensors and protected by applicable intellectual property laws. Except as explicitly granted, no rights are transferred to you.
9. Termination
You may stop using the service at any time. We may suspend or terminate access for material breach, legal requirements, security concerns, or prolonged non-payment. Certain provisions (including payment obligations and liability limits) survive termination.
10. Disclaimer of Warranties
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the extent permitted by law, Hellotik and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising from use of the service.
12. Indemnification
You agree to defend, indemnify, and hold harmless Hellotik from claims, liabilities, damages, and expenses arising from your use of the service, your content, or your violation of these Terms or applicable law.
13. Governing Law and Disputes
These Terms are governed by applicable laws of the jurisdiction where the service provider is established, unless mandatory consumer law states otherwise. Disputes will be handled in competent courts of that jurisdiction unless otherwise required by law.
14. Changes to Terms
We may update these Terms from time to time. Continued use of the service after updates become effective means you accept the revised Terms.
